The Attorney General's Office announced that it will initiate legal action against private banks that do not comply with the resolution signed between the Superintendency of Banks and Insurance (SBS) and the Attorney General's Office.
On March 21, the owners of the two entities decided to return the money to more than 2,000 injured by computer crimes due to the fragility of the computer security of financial institutions.
But this decision was not accepted by the Association of Private Banks of Ecuador (ABPE) made up of 25 entities in the country. His representative, César Robalino, pointed to the inter-institutional decision as "an eyesore" and argued that it is inapplicable. However, he said it should be reviewed on a case-by-case basis to analyze delivery.
The Attorney General, Washington Pesántez, on the basis of Article 30 of the General Law of Institutions of the Financial System, ordered the initiation of criminal proceedings for contempt of banks that do not comply with the provision to compensate the money to customers who are victims of computer fraud.
Pesántez said the resolution was agreed with executives of the country's main banks.
The commission of both entities that investigated the cases of computer crimes concluded that responsibility is shared between the financial institutions and the client.
He affirmed that the resolution adopted by the Prosecutor's Office and the SBS is aimed at banks assuming their responsibility in these crimes.
